Question · Voice and AI
Do AI voice agents have to disclose that they are AI?
In the EU, the AI Act requires that people be told they are dealing with an AI, unless that is obvious, and it applies from 2 August 2026. In the US, an AI voice on an outbound call to a home phone needs the called person's prior consent, and the FCC has proposed a disclosure rule that we found it had not finalized as of October 2026.

It depends on where the call is made and who receives it. In the EU, a voice agent must tell people it is an AI unless that is obvious from the context. In the US, the answer turns on consent and on the direction of the call: an AI voice on an outbound call to a home phone needs prior consent, and the FCC has proposed an AI disclosure rule that we did not find in force. This is general information, not legal advice, so check the rules for each country and each type of call with counsel before you deploy.
In the EU, an agent must say it is AI unless that is obvious
Article 50(1) of the EU AI Act requires providers to design AI systems that interact directly with people so that those people are informed they are interacting with an AI system 1. The article applies from 2 August 2026 2, so it applies now, as of this page's date.
The duty has an exception. It does not apply where the AI nature is obvious to a reasonably well-informed, observant and circumspect person, 3. A caller who dials a support line and hears a voice that introduces itself as an assistant may find the point obvious. A cold outbound call is harder to justify this way, because the person did not choose to talk to a machine. The safer course is to state it at the start of the call.
In the US, an AI voice on a robocall needs prior consent
In a 2024 declaratory ruling, the FCC said that the limits on artificial voices under the Telephone Consumer Protection Act (TCPA) cover current AI technologies that generate human voices 4. The TCPA already bars calls to a residential line that use an artificial or prerecorded voice to deliver a message without the called party's prior express consent, unless an exception applies 5.
So an outbound agent that reads a message to a home phone needs consent before the call, whether or not it says it is an AI. Disclosure and consent are separate duties. Disclosure does not replace consent, and consent does not remove the need to say what the agent is.
The FCC has proposed a disclosure rule, not a final one
In 2024 the FCC proposed rules that would require callers to disclose to consumers when they receive an AI-generated call 6. That is a proposal. We found no final order adopting it in the sources we checked as of October 2026, so do not assume it binds you yet. Plan for it anyway, because the proposal points the same way as the EU rule: say so at the start of the call.
Inbound agents face fewer FCC rules than outbound ones
The FCC's 2024 proposal says that the TCPA's requirements do not extend to technologies used to answer inbound calls 7. An agent that answers a call the customer placed is in a different position from one that dials out.
That difference is not a free pass. The EU rule covers both directions, and other US laws, such as state rules and the terms of your phone carrier, may still apply. Check your own situation.
Penalties for AI-voice calls can be large
In September 2024 the FCC imposed a $6,000,000 penalty on Steve Kramer for an AI-voice robocall campaign that targeted New Hampshire voters 8. That case was a deliberate campaign, not a commercial agent, so it shows the scale of penalties rather than a typical one. It is a reason to treat AI-voice calls as a legal matter from the first design decision, not after launch.
It depends on country, direction and the caller
| Situation | What the sources say |
|---|---|
| Agent talks with a person in the EU | Must inform the person it is an AI, unless that is obvious 1 |
| Outbound AI voice call to a US home phone | Needs prior express consent under the TCPA 5 |
| Outbound AI call in the US, disclosure at the start | FCC proposal would require it; not yet a final rule in our check 6 |
| Inbound agent in the US | FCC proposal does not reach technology answering inbound calls 7 |
State rules may also apply to robocalls and AI, so check the state of the person you call as well as your own.
What to do
- Identify the country of each caller and the direction of each call, inbound or outbound.
- Say that it is an AI at the start of every call. The rule is clearest in the EU, and the FCC proposal points the same way. Do not rely on the obvious exception unless counsel agrees.
- Get prior express consent before any outbound AI voice call to a US home line, and keep a record of how and when it was given.
- Keep call records that show the disclosure and the consent, with your retention rules.
- Ask counsel to review the script, the consent wording and the call flow before launch.
