Which law applies when you record a call across state lines?
No single rule settles it. When the two ends of a call are in different states, the stricter state's consent rule can apply, and a California court applied California law to calls with California clients. Meet the stricter standard whenever any participant is in an all-party state.

When a call crosses a state line, the stricter state's recording rule may apply, even if your own state allows the recording. No single statute says which state's law wins in every case. Courts decide the question case by case, looking at which state has the stronger interest in the outcome. The practical rule is to meet the strictest standard that could apply to anyone on the call. This page is general information, not legal advice.
The stricter state's rule can protect the person on the other end
The California Supreme Court faced this problem in 2006. It found a true conflict between California and Georgia law over a Georgia firm's recordings of calls with California clients. 1 It then concluded that the comparative impairment analysis supported applying California law to those calls. 2
The lesson is about the other end of the line. A person in an all-party state can rely on that state's statute, even when the recording is made in a state that allows it. California's Penal Code 632 makes it an offence to record a confidential communication without the consent of all parties. 3 So a call from a one-party state to a California resident can still raise the California rule.
The federal rule does not settle the state question
The federal Wiretap Act is a one-party rule. Interception is not unlawful under it when the person is a party to the communication or one party has consented. 4 That is a floor, not a ceiling. A call that is lawful under federal law can still be unlawful under the law of a state where one participant is located, and the state rules are where the conflicts happen.
Courts look at where the parties are and what they expected
The Kearney court did not simply apply the law of the state where the recording was made. It used a comparative impairment analysis, which weighs how much each state's rule would be impaired, and it applied California law to the calls. For a person recording a call, the questions a lawyer would ask are where each participant is, and which state's rule the recording would affect. A list of states cannot answer those questions for a specific call.
Some states also use a different test for different kinds of communication. Oregon, for example, treats a telecommunication you are not part of differently from a conversation obtained by device. 5 6 A call across a state line can therefore fall under more than one test.
Announcing the recording at the start of the call matters
In Kearney, the court addressed what happens when the business gives notice. It said that if a business tells a caller at the start of a telephone call that the call is being recorded, the recording would not violate California's statute. 7 That statement is specific to the facts of that case and to California law, so do not read it as a general safe harbour. It does show why a clear announcement, made at the start and recorded, is the first step in any cross-border call.
What to do before recording a call across a state line
- Find out the state of every participant, including people who join late or dial in on a conference line.
- Assume the stricter rule applies if any participant is in an all-party state such as California, Florida, Maryland or Washington. Our question on which states require all-party consent explains the list and its limits.
- Announce the recording before it starts, name everyone who will hear it, and record each person's agreement.
- Stop if anyone objects, or move the discussion to a method that does not record.
- Keep the notice and the consent with the recording, and limit who can access it.
If the call also involves an AI notetaker, the same rules apply with added checks on what the tool keeps, as set out in our question on AI notetakers and consent. For calls that cross a national border, see whether it is legal to record a phone call in the UK or EU.
