Is Whisper AI HIPAA compliant?
No, Whisper is not HIPAA compliant by itself, because compliance describes how a setup handles protected health information, not the name of the model. Local use can fit HIPAA with a documented risk analysis and no outside party handling the audio. The hosted OpenAI API can process protected health information only under a signed Business Associate and Healthcare Addendum and a provisioned organization.

No. HIPAA compliance describes how you handle protected health information (PHI), not what the model is called, so Whisper is not compliant by itself. A local setup can fit HIPAA if you complete a risk analysis and no outside party handles the audio. The hosted OpenAI API can process PHI only under a signed agreement and for an organization that OpenAI has set up for it.
No product is HIPAA compliant on its own, and vendors say so
Compliance belongs to the way an organization uses a product. Microsoft says there is currently no certification standard that the Department of Health and Human Services approves to demonstrate HIPAA compliance by a business associate 1. It also says that using its services "doesn't on its own achieve HIPAA compliance" 2. The same logic applies to Whisper. The name on a model or an app is not a compliance claim, so treat any "HIPAA compliant" label as a claim to check.
Local Whisper: no outside party receives the audio, but your duties remain
HIPAA defines a business associate as a person who, other than as a member of the covered entity's workforce, creates, receives, maintains or transmits protected health information 3. When the model runs on your own computer, its authors never receive your recordings. In our reading, a purely local setup therefore involves no business associate agreement with OpenAI. That reading is ours, not a legal opinion, so confirm it with your compliance team.
Local use does not remove your duties. The HIPAA Security Rule makes an accurate and thorough risk analysis of the risks to electronic PHI a required implementation specification 4. A laptop holding unencrypted dictated notes is a risk even if no server ever received the audio. Document how the device is encrypted, who can open the transcripts and how long you keep them.
The hosted OpenAI API needs a signed agreement and a provisioned organization
HHS says that the covered entity and a cloud service provider holding its health information must enter into a HIPAA-compliant business associate agreement 5. For OpenAI's API, the company says that customers who have signed its Business Associate and Healthcare Addendum can use BAA-eligible endpoints to process PHI, once the organization is provisioned with Private Retention and Private Safety Processing 6.
Both conditions must be met. The signed addendum is a contract, and the provisioning is a setting OpenAI applies to your organization. A personal account meets neither. The page also does not say that every audio endpoint is covered, so ask OpenAI to confirm the specific endpoint you plan to use. Under the Privacy Rule, the covered entity must also obtain "satisfactory assurance" that a business associate will safeguard the information 7, and the signed agreement is how that assurance is given.
Apps named after Whisper need their own answer
Superwhisper's documentation recommends its bring-your-own-key setup for organizations that already have HIPAA business associate agreements with an AI provider 8. That is the vendor's recommendation, not a legal finding that the setup complies. You still need the agreement with the provider, and the app's own terms do not replace it. Check any app the same way: does it sign a business associate agreement with you, does it send audio to a third party, and is that third party covered by your agreement with it?
What to do: a checklist before any PHI is dictated
- Decide whether the audio will contain PHI at all. Many dictation tasks do not.
- For local use, keep the audio on an encrypted device, complete the risk analysis and document it.
- For the OpenAI API, sign the addendum, confirm your organization is provisioned and get the endpoint's eligibility in writing.
- For any app, confirm in writing whether it signs a business associate agreement covering the processing it does.
- Review each transcript against its audio before you file it, because Whisper can invent text. Our question on why Whisper hallucinates explains the failure.
- Have a compliance officer or lawyer in your jurisdiction confirm the arrangement. This describes the rules and is not individual legal advice.
