7th Circuit Confirms BIPA Amendment Has Retroactive Application, Paul Hastings, 2026, Quotation of the amended statutory text.
Open the original- What it measures
- The amendment answers a question the 2023 Illinois Supreme Court ruling had left open: damages had been assessed per scan. The client alert quotes the amended text for collection and for disclosure.
- What it does not show
- The rule covers repeated collection of the same identifier from the same person by the same method. It does not reduce the consent duty, and it does not change the per-violation amounts. A later collection by a different method, or from a different person, can still count separately.
